Appointment Summary

The appointment of Andrew Fielding and Helen Newman as court-appointed Receivers, and Receivers and Managers, over the Corporate and Individual Defendants has changed.

The Australian Securities and Investment commission applied to the Federal Court to wind up the Corporate Defendants.

On 14 October 2025 the Federal Court of Australia appointed Andrew Fielding and Helen Newman as Joint and Several Liquidators of the remaining Corporate Defendants. The below document (The ALAMMC Group - List of Corporate and Individual Defendants) reflects this change.

There is no change to the appointment of Andrew Fielding and Helen Newman as Receivers and Managers of the fourteenth and fifteenth Defendants (David McWilliams and Laura Fullarton).

There is also no change to the appointment of private Receivers and Managers of the various Defendants’ property.

Status Update July 2026

Following an investigation by ASIC, ASIC filed interlocutory proceedings to commence contempt of court proceedings against Mr McWilliams and Ms Fullarton on 27 November 2025. Judgement on this matter was reserved.

Following an investigation by ASIC the Director of Public Prosecution filed for charges of fraud by Mr McWilliams. In June 2026 Mr McWilliams appeared in the Southport Magistrates Court on 13 criminal charges. If found guilty Mr McWilliams faces imprisonment of up to 20 years. Applications are underway for ‘pooling’ of assets and liabilities, and the remuneration of the Receivers & Managers’ appointments of the Defendants.

Next Update

The Liquidators’ have provided their statutory reports. Creditors should refer to previous reports. The Liquidators are continuing with the matters outstanding as outlined in their three-month reports to creditors.

Applications to court will be made for ‘pooling’ of assets and liabilities, and the remuneration of the Receivers & Managers’ appointments .

Subject to the legal matters of contempt and fraud, and court’s decision in relation to the pooling and remuneration matters, a further update will be provided.

There is no statutory date for the Liquidators to provide a further update, however, should a significant change in the liquidation arise, the Liquidators will write to all creditors.

Employees were notified of the Liquidators’ appointment and if entitled were directed to submit any claims for unpaid employee entitlements to the Fair Entitlements Guarantee (FEG) scheme.
